Court Upholds Domestic Drone Use in Arrest of American Citizen
Submitted by P.Au.L on Thu, 08/02/2012 - 16:19A motion to dismiss charges based on the use of a Predator drone was denied Wednesday
[US News] A North Dakota court has preliminarily upheld the first-ever use of an unmanned drone to assist in the arrest of an American citizen.
A judge denied a request to dismiss charges Wednesday against Rodney Brossart, a man arrested last year after a 16-hour standoff with police at his Lakota, N.D., ranch. Brossart's lawyer argued that law enforcement's "warrantless use of [an] unmanned military-like surveillance aircraft" and "outrageous governmental conduct" warranted dismissal of the case, according to court documents obtained by U.S. News.
District Judge Joel Medd wrote that "there was no improper use of an unmanned aerial vehicle" and that the drone "appears to have had no bearing on these charges being contested here," according to the documents.

I'm wondering that myself
That seems to have escalated rather quickly.
Before this, the state had problems staying under 500 ft from
the ground, as that is the maximum height to take pictures from air legally.
Now, the drone has brought to us a fully functional and fully legal evidence accumulating apparatus that WILL BE THE ACHILES HEEL of all the growers in the rural areas who supply the most delicious herbs.
ITS ALL ABOUT THE DRUG WAR, and the FEDS just stepped it up.
now what are we going to do about it?

We...
...are so screwed.

And in the end it doesn't matter what they think is true...
...The drones can kill you both abroad and in the homeland too!

why isn't this on the front page yet?
Why?
Why didn't Brossart return the cows?
How did this: "Court records state that last June, six cows wandered onto Brossart's 3,000 acre farm, about 60 miles west of Grand Forks. Brossart allegedly refused to return the cows," lead to an, "armed standoff with the Grand Forks police department?"
I'm missing a piece of reporting to be able to come to a conclusion.
Love thy enemy.
Welcome to the future..
If we don't change it.

I try to change people every day. Do You?
First they came for the Al Qaeda leaders
And we didn't speak out because we weren't Al Qaeda leaders.
Then they came for the transnational terrorists.
And we didn't speak out because we weren't transnational terrorists.
Then they came for American criminals.
And we asked ourselves if we should speak out for the American criminals.
Next they will come for innocent US citizens.
If we haven't spoken out by then, there will be no one left to speak out for us.
best of luck you you all

was the drone a police
was the drone a police vehicle, a military vehicle, or a vehicle owned by "somebody else"?
If it was military shouldn't this all have been thrown out on the basis of not allowing military marshal law on US soil?
It was
A Homeland Security drone
I guess I'm not alone
and yet
they give tanks to police, is that still acceptable? just because police isnt military by definition?

... just lost his cushy job. He may not know it yet, but the way We The People can really turn this thing around is by voting judges off the bench. Get organized in your district and KICK ASS

It seems like there is
A bit of over-reaction to this. The drone was not used to gather evidence of a crime but for assisting in executing a warrant issued by a judge. There is a huge difference. Had the drone been used to assist in the investigation, and the judge upheld that clear violation of our rights, he should be thrown off the bench. This is clearly not what happened. We should work to eliminate the surveilance state that we find ourselves in but we must be clear about what is a violation.

I thought Lakota was
I thought Lakota was sovereign territory, or is this outside the Indian nation territory?
Sounds like a violation of Posse Comitatus... if Posse Comitatus actually had any legal teeth to it anymore. Unfortunately, the Dork Knight has risen.

sounds like serious action needs to be taken
against our legal dept. Traitors in our midst allowing use of military on our soil.
We should form a "Citizens vs District Judge Joel Medd" and have him charged on traitors actions. Teach future judges they need to obey the "Supreme law of the land" the Constitution.
